6. Pay-What-You-Want (Donation-Based Pricing)
(a) Most Products are offered on a pay-what-you-want basis to support our charitable work.
(b) Where a Product is supplied in return for payment, it remains a consumer sale under UK law. Your statutory cancellation and refund rights therefore still apply.
(c) If you request a refund, we may invite you to convert it into a donation to support our mission — this is entirely voluntary.
7. Forming the Contract
(a) Product details and prices are displayed for your information.
(b) While we take care to ensure accuracy:
- all items are subject to availability;
- packaging may vary from images;
- colours may differ slightly due to device displays;
- dimensions are approximate.
(c) When you place an order you will receive an acknowledgement email; acceptance occurs only when we email you confirming dispatch.
(d) If we cannot fulfil your order, we will notify you and refund any payment made.
(e) We may decline orders at our discretion.
8. Our Right to Vary These Terms
(a) We may amend these Terms to reflect legal, operational, or regulatory changes.
(b) The Terms in force when you place your order apply.
9. Method of Payment
(a) We accept Visa, Mastercard, PayPal, and bank transfer.
(b) Payment is taken at the time of order; ownership passes once full payment is received.
(c) You confirm you are authorised to use the chosen payment method.
(d) We cannot accept card details by email — please order directly through the Website.
10. Delivery
(a) Delivery is available to UK mainland addresses only.

(c) We aim to process orders within 5 working days and deliver within 14 working days.

11. Rights of Cancellation, Return and Refund
(a) You may cancel or amend an order any time before dispatch.

(c) Returns are accepted within 30 days of delivery if items are:
(i) unused and in resalable condition;
(ii) in original packaging; and
(iii) accompanied by proof of purchase.
(d) Return items at your own cost using a tracked service to:

(e) Refunds are issued to the original payment method within 14 days of us receiving the goods.
(f) Delivery charges are refunded only if the item was faulty, damaged, or sent in error.

12. Consumer Customers
(a) You have a legal right to cancel your order within 14 days of receiving your goods.
(b) To cancel, email shop [at] sussexheartcharity [dot] org with your order number.
(c) This right does not apply to personalised items, sealed items opened after delivery, digital downloads once accessed, or dated event tickets.
(d) Faulty or mis-described goods will be repaired, replaced, or refunded in line with your statutory rights.
13. Business Customers
(a) Business purchases are accepted only at our discretion.
(b) Our total liability for business sales is limited to the price paid.
14. Limitation of Liability
(a) We are responsible only for foreseeable loss or damage caused by our breach or negligence.
(b) We are not liable for business losses, loss of profits, or indirect damages.
(c) Nothing in these Terms limits or excludes liability for:
(i) death or personal injury caused by negligence;
(ii) fraud or fraudulent misrepresentation; or
(iii) defective products under the Consumer Protection Act 1987.

16. Assignment
We may transfer our rights and obligations under this contract to another organisation provided this does not affect your rights.
You may not transfer your rights without our written consent.
17. Third Party Rights
This contract is between you and The Sussex Heart Charity.
No third party has any right to enforce its terms.
18. Severance
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain valid.
19. Entire Agreement and Waiver
These Terms form the entire agreement between you and The Sussex Heart Charity.
Failure to enforce any right does not waive that right.
20. Governing Law and Jurisdiction
These Terms are governed by English law.
Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
